Welcome to Asili Roots. The terms "Asili Roots," "we," "us," and "our" refer to Asili Roots. We operate this store and website, including the information, content, features, products, tools, and services available through it (collectively, the "Services").

By accessing, browsing, using our Services, creating an account, placing an order, or signing up for communications, you agree to these Terms of Service and to any policies referenced in them.

If you do not agree to these Terms, you should not use or access our Services.

Asili Roots is an online apparel and lifestyle brand offering made-to-order products inspired by culture, heritage, identity, and community.

Our store is powered by Shopify, and we use selected third-party service providers to operate our ecommerce store, process payments, produce and fulfill orders, ship products, provide customer support, and send communications.

By using our Services, you represent that you are at least the age of majority in your place of residence, or that you have the consent of a parent or legal guardian where required.

You may be asked to provide information such as your name, email address, phone number, billing address, shipping address, payment information, and order details. You agree that the information you provide is accurate, current, and complete.

You are responsible for maintaining the confidentiality and security of any account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to another person.

Our products are made to order. This means production generally begins after an order is placed and accepted.

We make reasonable efforts to display product colors, artwork, sizing, descriptions, and images accurately. However, product appearance may vary due to screen settings, production methods, garment blanks, fabric texture, print provider processes, and other factors.

Product descriptions, prices, colors, sizes, availability, and designs may change without notice. We may discontinue products or limit product availability by person, region, jurisdiction, product type, provider, or market.

Some product images may be mockups or representative images. The final physical product may differ slightly from the digital preview while still reflecting the ordered design, color, size, and product type.

When you place an order, you are making an offer to purchase the selected products. We may accept or decline an order for reasons including payment issues, suspected fraud, unavailable products, incorrect information, fulfillment restrictions, shipping limitations, pricing errors, or legal compliance concerns.

Your order is not accepted until we confirm acceptance or begin processing the order. Payment authorization or payment capture does not by itself require us to accept an order if there is a legitimate issue with the order.

Please review your order carefully before submitting it. Because our products are made to order, we may be unable to accommodate cancellation or change requests after an order is accepted or production has started. This does not limit any mandatory cancellation or consumer rights that may apply to you under applicable law.

We may contact you using the email address, billing address, shipping address, or phone number provided at checkout if we need to confirm, modify, reject, or cancel an order.

Prices, discounts, promotions, and product availability may change without notice. The price charged for a product will generally be the price shown at the time the order is placed and confirmed in your order confirmation email.

Unless clearly stated otherwise, product prices do not include shipping, handling, customs duties, import taxes, VAT, brokerage fees, or other destination-specific charges.

Shipping costs are calculated at checkout based on the shipping address, products in the order, and available shipping methods.

International orders may be subject to customs duties, import taxes, VAT, brokerage fees, or other charges depending on the destination country. Unless such duties and taxes are clearly collected at checkout, these charges are the responsibility of the customer and may be collected by the carrier or local authorities before delivery.

We are not responsible for delays caused by customs processing or for additional import charges applied by your country.

Shipping and delivery information is described in our Shipping Policy. Delivery dates are estimates only and are not guaranteed.

We are not responsible for delays caused by print providers, shipping carriers, customs processing, incorrect addresses, local postal conditions, force majeure events, or other circumstances outside our reasonable control.

If an order contains multiple items, the items may be produced by different print providers and may ship separately. You may receive more than one tracking number.

Risk of loss or damage passes to you when the products are delivered to you or to a person designated by you, except to the extent a different rule applies under mandatory consumer protection law.

Returns, refunds, exchanges, damaged items, cancellations, and order issues are handled in accordance with our Refund Policy.

Nothing in these Terms or in our policies is intended to limit any mandatory consumer rights you may have under applicable law, including rights relating to defective goods, goods that do not match their description, or statutory withdrawal rights where applicable.

For made-to-order products, please review your order details carefully before placing your order. If you receive a damaged, defective, incorrect, or incomplete item, contact us as soon as possible with your order number and photos of the issue so we can review the case.

We may offer discounts, coupon codes, bundles, free shipping offers, gift cards, or other promotions. Promotions may be subject to additional terms, eligibility rules, expiration dates, minimum order values, market restrictions, product exclusions, or other limitations.

Promotions cannot be applied retroactively unless we expressly agree. We may modify, suspend, or end a promotion at any time where permitted by law.

All content available through our Services, including designs, artwork, product images, mockups, text, graphics, logos, photographs, videos, layouts, and brand elements, is owned by Asili Roots or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may use our Services for personal, non-commercial purposes only. You may not copy, reproduce, distribute, modify, sell, exploit, publish, or create derivative works from our content without our prior written permission.

Asili Roots names, logos, product names, designs, slogans, and brand elements may be trademarks or trade dress of Asili Roots. Shopify and other third-party names, logos, products, and services are the property of their respective owners.

If you submit reviews, photos, comments, feedback, suggestions, or other content to us or through our Services, you grant us a non-exclusive, worldwide, royalty-free right to use, reproduce, display, publish, adapt, and share that content for operating, improving, and promoting our business, where permitted by law.

You represent that you have the rights necessary to submit such content and that your content does not violate the rights of any third party or any applicable law.

We may remove or refuse content that we consider unlawful, offensive, misleading, infringing, abusive, spam-like, or otherwise inappropriate.

Our Services may include third-party tools, links, apps, payment providers, marketing tools, analytics tools, embedded content, or other third-party services. We do not control third-party websites or services and are not responsible for their content, accuracy, practices, availability, or policies.

Your use of third-party services may be subject to their own terms and privacy policies. Please review those policies before using third-party services or providing information to them.

Asili Roots is powered by Shopify, which enables us to provide the Services. However, purchases made through our store are made directly with Asili Roots. Shopify is not responsible for the products we sell, our fulfillment, our customer support, or the transaction between you and Asili Roots, except to the extent Shopify is directly providing services to you under its own terms.

Our collection, use, and sharing of personal information is described in our Privacy Policy.

Depending on your location, you may see a cookie consent banner that allows you to accept, decline, or manage certain cookie and tracking preferences.

Email and SMS marketing are subject to your consent, preferences, opt-out choices, and applicable law. You can unsubscribe from marketing emails using the unsubscribe link in our emails. You can opt out of SMS marketing as described in the SMS Program Terms below and in our Privacy Policy.

If you opt in to receive SMS messages from Asili Roots, you may receive text messages about promotions, product launches, cart or browse reminders, order-related updates, shipping updates, or other brand communications, depending on the type of consent you provided.

SMS consent is optional and is not a condition of purchase. Message frequency may vary. Message and data rates may apply.

You can opt out of SMS marketing at any time by replying STOP to our messages or by following any other opt-out instructions provided in the message. For help, you may reply HELP where supported or contact us at support@asiliroots.com.

You represent that you are the subscriber or customary user of the phone number provided and that you have authority to consent to receive messages at that number. You agree to notify us if you change or deactivate your number.

Wireless carriers are not liable for delayed or undelivered messages. Delivery depends on your wireless provider, network availability, and device settings.

We may use Klaviyo or other messaging service providers to manage email and SMS communications. Our Privacy Policy describes how we collect, use, share, and retain information related to SMS communications.

We may modify, suspend, or discontinue the SMS program or any part of it where permitted by law. We will provide notice where required.

You agree not to use the Services for unlawful, harmful, fraudulent, abusive, infringing, or unauthorized purposes.

You must not use the Services to violate any law, infringe intellectual property rights, harass or harm others, submit false information, upload malicious code, scrape or collect personal information, interfere with security features, spam, phish, impersonate another person or entity, or exploit any part of the Services without authorization.

We may suspend or terminate access to the Services if we believe you have violated these Terms or applicable law.

We may update, modify, suspend, discontinue, or restrict access to any part of the Services at any time, where permitted by law.

We may terminate or suspend your access to the Services if you breach these Terms, create risk for us or others, violate applicable law, or misuse the Services.

Sections that by their nature should survive termination will continue to apply, including Intellectual Property, Privacy, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and Contact Information.

The Services and their content are provided for general information and shopping purposes. We make reasonable efforts to keep information accurate, but we do not guarantee that all content is complete, current, error-free, or uninterrupted.

To the fullest extent permitted by law, the Services are provided on an "as is" and "as available" basis. We disclaim warranties and conditions that may be excluded by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, Asili Roots and our partners, service providers, officers, employees, contractors, licensors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, savings, data, goodwill, or similar losses arising from your use of the Services or products purchased through the Services.

Nothing in these Terms limits liability that cannot legally be limited, including liability for intentional misconduct, gross negligence, personal injury caused by negligence where applicable, fraud, fraudulent misrepresentation, or mandatory consumer rights.

To the extent permitted by law, you agree to indemnify and hold harmless Asili Roots, Shopify, and our affiliates, partners, service providers, officers, employees, contractors, and licensors from claims, losses, liabilities, damages, costs, and expenses arising from your breach of these Terms, your misuse of the Services, your violation of law, or your violation of third-party rights.

These Terms are intended to apply only to the extent permitted by law. If you are a consumer, you may have mandatory rights under the laws of your country, state, province, or region. Nothing in these Terms is intended to exclude, restrict, or modify any consumer rights that cannot be excluded, restricted, or modified by contract.

These Terms are governed by the laws of Germany, without prejudice to any mandatory consumer protection laws that may apply in your country or region of residence.

Where permitted by law, disputes may be brought before the competent courts in Germany. If you are a consumer, you may also have the right to bring claims in the courts of your place of residence or to rely on mandatory legal protections available to you under local law.

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will remain in effect.

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and any other policies or notices referenced in them, form the agreement between you and Asili Roots regarding your use of the Services.
